FAQ

WHAT IS A "POOL" ?

A swimming pool means an excavation, structure or vessel: (a) that is capable of being filled with water to a depth greater than 300 mm and (b) that is solely or principally used, or that is designed, manufactured or adapted to be solely or principally used, for the purpose of swimming, wading, paddling or any other human aquatic activity, and includes a spa pool, Therefore, in ground, above-ground, indoor, portable and other types of swimming pools and spa pools are included in these new swimming pool safety laws.

HOW LONG IS A CERTIFICATE VALID?

A Non-Compliance certificate is only valid for 1 year, although a compliance certificate is valid for 3 years.

Once your Compliance Certificate has expired, give us a call in order to conduct another inspection in which when your pool is deemed compliant another certificate can be issued. the help they need quickly and easily.

I THOUGHT COUNCIL COULD ONLY INSPECT AND ISSUE CERTIFICATES?

No you are wrong No, this is incorrect private sectors are also empowered to issue Compliance and Non Compliance certificates upon completion of their inspection’s.

Every pool owner must ensure their pool complies with the laws that applied when their pool was built.

Or, if the pool fence has been substantially altered since then, it must comply with the standard that applied at the time of the alteration.

This does not mean you need an inspection, but you must make sure the pool barrier is compliant.

For most pool owners, it is almost impossible to understand all the legislation to work out if the pool barrier complies. Most pool owners need advice from a Pool Safety Inspector.

ARE YOU SELLING OR LEASING?

From 29th April 2016, a copy of the following must exist before you can sell your property:

• A valid Certificate of Compliance, or

• A relevant Occupation Certificate (a relevant occupation certificate is an occupation certificate issued under the Environmental Planning and Assessment Act 1979 that is less than 3 years old and that authorises the use of the swimming pool)

Remember if you are selling your property you require either a compliance or non-compliance certificate. If either document is needed to ensure that you are able to sell your property.

ARE YOU BUYING OR RENTING?

From 29th April 2016, a copy of the following must exist before you can sell your property:

Remember if you are buying a property you are required to fix the pool/spa fence to ensure that is compliant within 90 days of settlement. If this is not done they you may receive notices or orders from your local Council, which can lead to being fined or ending up in court.
